These Terms and Conditions apply to all photography and related services provided by True Depth Productions. By making a booking, submitting an online booking form, or engaging True Depth Productions' services, you agree to be bound by these Terms and Conditions.
1. Bookings
All bookings are made either via our online booking system or through direct communication with True Depth Productions. A booking is considered confirmed once submitted online or confirmed in writing.
Clients are responsible for ensuring all booking details are accurate, including property address, access instructions, and selected services.
2. Pricing and Payments
Pricing is not publicly listed on our website and is provided to clients in PDF format upon request. Prices applicable to a booking are those agreed upon at the time the booking is confirmed.
Payment is required in full before unwatermarked images, floor plans, or other deliverables are released, unless otherwise arranged in advance.
True Depth Productions primarily accepts online payment, which allows for the fastest delivery of final products. Alternative payment methods, including bank transfer, may be accepted upon request and approval; however, processing times may be longer, and delivery of unwatermarked content may be delayed until payment has been confirmed.
True Depth Productions reserves the right to withhold final deliverables until payment has been received in full.
3. Cancellations and Rescheduling
- Same-day cancellations incur a $50 cancellation fee.
- No-shows or inability to gain access incur a fee of:
- $100 for floor plan–only jobs
- $150 for photography or combined services
“Inability to gain access” includes, but is not limited to:
- Locked properties
- Incorrect or missing access details
- Agent not present
- Tenant or owner not present
- Keys, door codes, or lock boxes not available
- Property not ready for photography, including:
- Cleaning not completed
- Styling or staging not completed
- Ongoing construction or renovations
In cases where the property is not ready due to the above reasons, True Depth Productions will communicate with the agent or client to determine the best course of action. Rescheduling may be arranged at True Depth Productions’ discretion, but applicable no-show or access fees may still apply, as delays result in loss of income.
Rescheduling due to weather, particularly for exterior photography or drone services, may be accommodated at the discretion of True Depth Productions.
4. Property Access, Readiness, and Cleanliness
The client is responsible for ensuring:
- The property is accessible at the scheduled time
- The property is ready for photography
- Pets are secured
- Utilities such as power and lighting are available
True Depth Productions is not responsible for cleaning, tidying, or staging properties. Minor adjustments may be made to improve presentation; however, the overall cleanliness and condition of the property will affect the final images.
Delays caused by property readiness issues may result in additional charges or reduced coverage.
5. Image Delivery and Turnaround Times
Standard turnaround time for most jobs is the next business day. This is a target timeframe and not a guaranteed delivery time.
Delivery times may be longer for:
- Large or complex jobs
- Additional edits or revisions
- Virtual staging
- Floor plans
- Services involving third-party editors or suppliers
Minor reasonable revisions may be requested. Extensive edits or changes beyond the original booking scope may incur additional fees.
True Depth Productions is not liable for delays caused by third parties or circumstances beyond reasonable control.
Images and other deliverables will initially be provided via Pixieset Gallery with watermarks applied. Watermarks are removed and full-resolution files are released only after payment has been received in full.
6. Usage and Licensing
All images and materials remain the copyright of True Depth Productions.
Upon full payment, the client is granted a non-exclusive licence to use the images solely for marketing the specific property photographed. This licence allows use for the duration of the marketing campaign for the photographed property and does not expire while the property remains actively marketed using the supplied imagery.
Permitted uses include:
- Online property listings
- Print advertising
- Social media marketing
- Signage related to the specific property
Images may not be:
- Sold
- Transferred
- Reused for future listings
- Used for other properties
- Provided to third parties without prior written consent
- Used for marketing prior to payment made in full
This licence does not require the removal of images from past marketing materials or social media posts once a campaign has concluded, provided the images are not actively reused for new marketing campaigns, future listings, or unrelated promotional purposes.
True Depth Productions retains the right to use images for portfolio, website, social media, and promotional purposes unless otherwise agreed in writing.
7. Drone Photography
Drone services are subject to:
- Weather conditions
- Airspace restrictions
- CASA regulations
- Safety considerations
True Depth Productions does not guarantee that drone photography can be completed at all locations. Where drone services cannot be performed, alternative options may be offered where possible.
8. Liability and Insurance
True Depth Productions holds appropriate Professional Indemnity and Public Liability insurance for the services provided.
While reasonable care is taken at all times, True Depth Productions is not liable for:
- Damage to property not caused by negligence
- Injury to persons not caused by our actions
- Losses resulting from delays, access issues, or third-party actions
To the maximum extent permitted by law, liability is limited to the cost of the services provided.
9. Events Outside Reasonable Control
True Depth Productions is not liable for failure or delay in performance due to events beyond reasonable control, including but not limited to severe weather, illness, equipment failure, regulatory restrictions, or other unforeseen circumstances.
10. Australian Consumer Law
Nothing in these Terms and Conditions excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.
11. Acceptance of Terms
By submitting a booking or engaging True Depth Productions, you confirm that you have read, understood, and agreed to these Terms and Conditions.
